Luigi Mangione’s state murder trial in the shooting death of UnitedHealthcare CEO Brian Thompson has been postponed indefinitely.

The state trial was scheduled to begin Sept. 8 but has been canceled. The move comes as his lawyers seek to have the case thrown out on double jeopardy grounds. That follows Mangione’s guilty plea to federal charges last week.

A judge issued an order Monday canceling the trial and giving the Manhattan District Attorney’s Office, which is prosecuting in the state case, until Oct. 9 to respond. A hearing will be held on Dec. 10, a week before Mangione is set to be sentenced in the federal trial.
