Trial Delayed For Mary Ann Elvington Case Regarding OnStar
In March of 2021, 80-year-old Mary Ann Elvington was kidnapped from her Nichols home.
The trial has been delayed in the Mary Ann Elvington case.
Back in March of 2021, the 80-year-old was kidnapped from her Nichols home. Dominique Brand forced her to drive them to N.C., then back to Dillon County. He eventually took over driving and headed into Marion County where he shot and killed her. Brand received two life sentences plus 120 years in prison for Elvington’s murder.
However, General Motors and the company’s in-vehicle assistance software company, OnStar were included in the lawsuit. Elvington’s family attempted to use OnStar to contact her and she responded up until she didn’t. OnStar refused to provide information on the vehicle’s location citing a policy requiring law enforcement involvement.
Court filings describe a dispute over whether OnStar should have provided her location sooner. OnStar argues they were not aware of the situation and are asking to be dismissed from the lawsuit. The trial was set to start this week but a judge ruled to grant a continuance and delay the court proceedings.
