Trump is accused of playing a major role in sparking the Capitol riot that occurred on January 6, 2021.

Prosecutors allege Trump took part in the rebellion through his words that prompted citizens to act out. His attorneys attempted to claim immunity that could protect Trump from being sued due to his presidential position.

In December, a Washington, DC appeals court concluded that Trump’s remarks to supporters on that day appeared to be delivered in his capacity as a candidate for reelection not in his official capacity as president. Therefore, Trump cannot claim immunity.

Without Trump challenging the ruling, it will stand, meaning the case can now move forward.
