Reese’s Possibly Violated Laws Through New Promotion

A popular candy brand has possibly violated a law with their new promotion.
Reese’s may be in violation of state and federal laws with its new sweepstakes offer currently advertised on packs of peanut butter cups. The promotion on two-cup packages states “You could win $25,000” and in smaller print those interested are instructed to read further details inside the package. However, after consumers have bought and opened a package, print on the inside claims that no purchase is necessary to enter the contest.
Sweepstakes are primarily governed by state laws, which require that no purchase must be made to participate. In this situation, customers have already made a purchase by buying the candy.
Hershey claimed in-store displays showed abbreviated rules for the sweepstakes, including how to enter without making a purchase and QR codes are on packages. Upon further review, candy displays in multiple states prove otherwise. An investigation has been opened.
