The 5th U.S. Circuit Court of Appeals overturned a previous decision by a panel that was made back in December.

A divided panel of the court initially sided with a federal district judge in Texas who said the buoys should be removed.

Now, the entire appeals court said the court abused its discretion in granting the preliminary injunction.

The panel ruled Tuesday that the floating barrier can stay for now.

The broader lawsuit is set for a trial beginning next week. In the case, the Biden administration accuses Texas of violating the federal Rivers and Harbor Act.
