Politico Obtains Supreme Court Draft Opinion that Would Overturn Roe v. Wade

It says the court would overturn Roe versus Wade's holding of a federal constitutional right to an abortion.

In a breach of court confidentiality, Politico has obtained a draft of a majority opinion that would strike down Roe versus Wade. The draft, which was written by Supreme Court Justice Samuel Alito was circulated in early February. It says the court would overturn Roe versus Wade’s holding of a federal constitutional right to an abortion, which means states would be able to set their own laws surrounding abortion. The opinion would be the most consequential abortion decision in decades and could potentially transform the landscape of women’s reproductive health in America. The justices can still change their minds on decisions and the court’s holding won’t be final until it’s officially published. Pro-life and pro-choice protesters have been outside the Supreme Court building since the news broke. President Biden reacted by saying a woman’s right to choose is fundamental…and that quote “Basic fairness and the stability of our law demand that it not be overturned.”
