The Supreme Court has halted the Trump administration’s ability to use the Alien Enemies Act.
The legislation enables migrants to be deported amid a declared war or an “invasion” by a foreign nation. The law has only been applied three previous times, during wars.
However, President Trump argues he can use it because the Venezuelan gang ‘Tren de Aragua’ is effectively invading the U.S..
The administration invoked the law last month to deport more than 100 migrants to a Salvadoran mega-prison.
The ACLU has argued against the use of the law and filed an appeal. Now the Supreme Court has temporarily blocked deportations until it can resolve the appeal.
