Trump Lawyers To Ask Judge To Dismiss Charges Related To Classified Documents
Prosecutors in the case have argued the documents contained information on issues including nuclear capabilities and U.S. vulnerability to military attack which could not be claimed as personal records.
Trump’s attorneys are expected to ask a federal judge Thursday to dismiss one of the federal criminal cases against him.
In this case, Trump has pleaded not guilty to a 40-count indictment that accuses him of illegally storing sensitive national security documents. He held them at his Mar-a-Lago estate after leaving office in January of 2021.
The former president’s lawyers are expected to tell the judge overseeing this case that Trump was authorized to keep the documents because he designated them as “personal” under a U.S. law on presidential records.

Thursday’s arguments will be focused on two of seven legal motions Trump has filed attempting to toss the charges. His other challenges include an argument for presidential immunity.
Trump also claims that other U.S. officials who retained classified records, including Biden, were not charged.
