Judge Blocks Montana’s Attempt To Ban TikTok Statewide

On Thursday, U.S. District Judge Donald Molloy issued a preliminary injunction stating that Montana's statewide ban of the app "oversteps state power and infringes on the constitutional rights of users."

A judge has blocked the state of Montana’s attempt to ban TikTok.

Back in May, Montana became the first state to issue a TikTok ban. The ban was set to be enforced starting in January.

Under the ban, every time a user was offered the ability to download the app, it would have been considered a violation of the ban which would carry at least a $10,000 penalty. TikTok and the app stores would have been held liable for the fines, not residents of Montana who used the app. However, users and TikTok owners brought a lawsuit against the ban.

On Thursday, U.S. District Judge Donald Molloy issued a preliminary injunction stating that Montana’s statewide ban of the app “oversteps state power and infringes on the constitutional rights of users.”
