DOJ To Appeal Comey, James Case Dismissal
The court ultimately ruled that the appointment of Lindsey Halligan as interim U.S. attorney in these cases was unlawful.
The Justice Department plans to appeal a federal judge’s dismissal of the criminal cases against former FBI Director James Comey and New York AG Letitia James.
The indictments against Comey accused him of lying to Congress five years ago and James was accused of mortgage fraud. Both pleaded not guilty to the charges, which James has called “baseless.”
The court ultimately ruled that the appointment of Lindsey Halligan as interim U.S. attorney in these cases was unlawful because she wasn’t confirmed by the Senate. Comey and James’ cases were dismissed ‘without prejudice,” meaning they could be refiled.
“We believe the attorney in this case, Lindsay Halligan, is not only extremely qualified for this position, but she was in fact legally appointed, and I know the Department of Justice will be appealing this in very short order,” White House press secretary Karoline Leavitt said.
