Donald Trump has requested for a judge to dismiss the government’s election interference case against him entirely.
The former president argued that all of his actions leading up to the January 6th attack on the Capitol are protected by presidential immunity.
The motion alleges the prosecution falsely claims that president Trump’s motives were impure and that he knew spreading reports of fraud and election irregularities were untrue but sought to address them anyway. However, the Constitution and the Supreme Court make it clear that the president’s motivations are not for the prosecution or court to decide.
Trump’s attorneys claim his actions were within the bounds of his office which means he is immune from prosecution. Trump is facing charges under three statutes claiming he engaged in a conspiracy to defraud the U.S., obstruct the certification of votes carried out by Congress, as well as a conspiracy against the right to vote and have one’s vote counted.
