Biden Administration Proposed New Asylum Restrictions

Migrants who traveled through other countries on their way to the US-Mexico border would not be able to apply for asylum.

On Tuesday, the Biden administration announced new legislation that prevents certain migrants from applying for asylum in the United States.

The proposed rule would limit asylum eligibility and encourage migrants to take legal and safe pathways into the U.S., or otherwise find asylum or other protection in countries through which they travel.

One goal for the motion would be to prevent reliance on human smuggling networks that transport migrants for money.

The rule would apply to migrants who illegally cross the US-Mexico border, but it does not apply to unaccompanied children.

The administration rejected the comparison to the Trump administration and said that it is not a categorical ban on asylum but a way to expand access to legal pathways to the U.S..

The proposed rule will be posted in the federal register for a 30-day public comment period and is expected to take effect in May when ‘Title 42’ is officially terminated.
