President Biden Unlikely to Use Executive Privilege Over Documents Pertaining to Jan 6th

President Biden has once again refused to assert executive privilege over documents that former President Trump has sought to keep out of the hands of the committee investigating the Capitol Riots. According to a letter, White House counsel Dana Remus informed national archivist David Ferriero yesterday that the President would not assert privilege over materials that trump requested remain secret as a matter of executive privilege. Trump has already filed a lawsuit to stop the National Archives from giving documents to Congress that he believes are privileged and the latest documents will likely become part of that lawsuit as well. The National Archives is scheduled to begin turning over records to the committee on November 12th unless Trump gets a court order.

Remus quoted her earlier letter to the archives highlighting the events that happened the day of the riots and also noted that President Biden instructs the National Archives to provide the documents to the committee 30 days after notifying Trump ‘absent any intervening court order.’ Earlier this month the White House told the National Archives that it would not assert executive privilege on an initial batch of documents that was requested by the committee.
