Texas Judge Rules Those in Fear of Catching COVID-19 May Mail In Ballots

A Texas judge last night ruled that anyone afraid of catching COVID-19 could vote-by-mail. District Judge Fred Biery said the “disability” provision in the state’s vote-by-mail election code can apply to all registered voters who were more at risk of catching COVID-19 and could fear catching the virus at a polling place. “Disability” in Texas is presently defined as “a sickness or physical condition that prevents the voter from appearing at the polling place on election day.” Biery added “fear and anxiety is inextricably intertwined with voters’ physical health.” This will also supersede a Texas Supreme Court decision issued Friday that prevented five counties from issuing mail-in ballots. This ruling comes as a victory for Texas democrats who have been fighting this battle in both federal and state courts against the state. Texas Attorney General Ken Paxton has already filed to appeal, arguing there will be people who take advantage of the decision.
